First National Real Estate Bribie Island Holiday Accommodation Terms and Conditions
Definitions
For the purposes of these Terms and Conditions:
Agent / Managing Agent means First National Real Estate Bribie Island, its employees, contractors and authorised representatives.
Booking means the reservation of a holiday rental property managed by First National Real Estate Bribie Island.
Guest means the person making the booking and any person occupying or visiting the property during the booking period.
Occupant means any person staying at or using the property during the booking period, whether approved as part of the booking or not.
Property means the holiday accommodation premises and all fixtures, fittings, furniture, equipment, appliances and inclusions located at the property.
Visitor means any person attending or entering the property during the booking period who is not a registered occupant.
Acceptance of Terms and Conditions
- By making a booking, paying a deposit, paying any monies towards a booking, completing the online check-in process, signing a Guest Registration Form, providing credit card details, accessing the property, or occupying the property, the Guest acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.
- The person making the booking warrants that they are at least 25 years of age and have the authority to accept these Terms and Conditions on behalf of all occupants and visitors associated with the booking. Where a property is subject to a minimum age requirement, the Guest must comply with the age requirements specified for that property.
- The Guest is responsible for ensuring that all occupants and visitors comply with these Terms and Conditions throughout the booking period.
Responsibility for Occupants and Visitors
- The Guest making the booking accepts full responsibility and liability for the conduct, actions and behaviour of all occupants and visitors attending the property during the booking period.
- Any loss, damage, breakage, additional cleaning, repair costs, replacement costs, call-out fees, penalties, charges, breaches of these Terms and Conditions or other expenses arising from the actions of any occupant or visitor will be the responsibility of the Guest and may be charged to the credit card provided in accordance with these Terms and Conditions.
- The Guest agrees that liability is not limited to the Guest personally occupying the property and extends to all occupants, visitors, invitees and any other person attending the property during the booking period.
Amendments to Terms and Conditions
- First National Real Estate Bribie Island reserves the right to amend, update or modify these Terms and Conditions at any time.
- The Terms and Conditions applicable to a booking will be those in effect at the time the booking is confirmed unless otherwise required by law.
- The current version of these Terms and Conditions will be available on our website and it is the responsibility of the Guest to review them prior to making a booking.
Internet Services
- Where a property is advertised as providing internet or Wi-Fi access, such service is supplied by third-party providers and is offered as a convenience only.
- First National Real Estate Bribie Island makes no warranty or guarantee regarding the availability, speed, reliability, quality, compatibility, coverage or uninterrupted operation of any internet or Wi-Fi service.
- Internet and Wi-Fi services are not considered an essential service and any interruption, outage, reduced speed, technical fault, maintenance issue or failure of the service shall not constitute grounds for compensation, refund, discount, relocation, cancellation or alternative accommodation.
- Guests who require internet access for business, employment, study, streaming, communications or any other purpose are solely responsible for arranging their own backup internet solution.
After-Hours Emergency Assistance
- The after-hours emergency service is provided exclusively for genuine emergencies requiring immediate attention that cannot reasonably wait until the next business day.
- Examples of emergencies include, but are not limited to, serious property damage, loss of essential services where immediate action is required, security breaches, lockouts where no alternative access is available, or circumstances presenting an immediate risk to persons or property.
- The after-hours emergency service is not a call centre and is operated by on-call staff. Whilst reasonable efforts will be made to respond promptly, response times may vary depending on the nature and urgency of the matter.
- Guests must leave a detailed voicemail or text message including their name, property address, contact number and details of the emergency if their call is not answered.
- Calls relating to maintenance requests, housekeeping matters, booking enquiries, internet issues, television issues, general information or other non-urgent matters may not be returned until normal business hours.
- First National Real Estate Bribie Island accepts no liability for delays in responding to non-emergency enquiries received outside normal business hours.
Payment Terms
- To secure a booking, a deposit equal to 25% of the total accommodation charges, together with the applicable booking fee, must be paid within seven (7) days of the reservation being made.
- The deposit forms part of the total accommodation cost and is not a security bond.
- The remaining balance of the booking must be paid in full no later than thirty (30) days prior to the scheduled arrival date.
- For bookings during the Christmas holiday period, the full balance of the booking must be paid by 1 November of the applicable year, regardless of the arrival date.
- Bookings made within thirty (30) days of the arrival date require full payment at the time of booking.
- Failure to pay the required deposit or final balance by the due date may result in cancellation of the booking without further notice. First National Real Estate Bribie Island reserves the right to cancel the booking and make the property available for re-letting.
- All bookings incur a $100 non-refundable booking fee.
- Where a cancellation is approved more than thirty (30) days prior to the scheduled arrival date, any refundable deposit amount will be refunded less the $100 non-refundable booking fee and any applicable non-refundable merchant processing fees.
- Payments must be made through the "Make a Payment" link provided by First National Real Estate Bribie Island. Guests may choose to pay by credit card, debit card or direct deposit through this secure payment portal.
- For direct deposit payments, our bank account details will be displayed when the "Make a Payment" link is accessed. Please note that selecting "Direct Deposit" does not automatically transfer the payment. You will need to log in to your internet banking and manually transfer the funds, or visit a Westpac branch to make the payment. To ensure your payment is correctly allocated to your booking, you must include your booking reference when making the transfer. Failure to provide the correct booking reference may result in delays in allocating the payment to your booking, and First National Real Estate Bribie Island will not be responsible for any cancellation, late payment fees, loss of booking, or other consequences arising from a payment that cannot be identified or allocated due to missing or incorrect reference details.
- Credit card and debit card payments are processed through our secure payment system and incur a non-refundable merchant processing fee of 2.25%, which will be added to the total amount payable.
- Cleaning fees and any additional charges applicable to the property or booking are included in the total booking cost and must be paid in accordance with these Terms and Conditions.
- Any costs incurred by First National Real Estate Bribie Island in recovering overdue amounts, including administration costs, debt recovery fees, legal costs and collection agency fees, may be recovered from the Guest.
Security Bond (Refundable)
- Please note that some properties require a refundable security bond to be paid no later than two (2) days prior to check-in. The security bond amount will generally range between $200.00 and $1,000.00, depending on the property.
- Where applicable, the security bond requirement and the specific amount payable will be clearly stated in the property description at the time of booking and confirmed in the booking confirmation invoice.
- Failure to pay the required security bond by the due date may result in cancellation of the booking, refusal of check-in, or the withholding of access details until the security bond has been received in cleared funds.
- The security bond is held as security against any damage, breakages, additional cleaning, excess rubbish removal, breach of these Terms and Conditions, or any other costs incurred during the Guest's occupancy.
- Following departure and a satisfactory property inspection, the security bond (less any applicable deductions) will be refunded.
- Refunds will be processed to a nominated Australian bank account provided by the Guest. It is the Guest's responsibility to supply correct and complete banking details to enable the refund to be processed. Delays in providing bank details may delay the refund process.
- Where deductions are required, the Guest agrees that the Agent may apply the security bond towards any outstanding amounts owed under these Terms and Conditions, with any remaining balance refunded accordingly.
Credit Card Security and Authorisation
- A valid credit card must be provided for all bookings.
- For bookings made through third-party booking platforms, including Booking.com, Stayz and VRBO, the Guest authorises First National Real Estate Bribie Island to collect, store and process the credit card details provided through those platforms in accordance with these Terms and Conditions.
- For bookings paid by direct deposit, valid credit card details must be provided prior to arrival and will be securely stored until the property has been inspected following departure and all obligations under the booking have been satisfied.
- Credit card and debit card payments are processed through our secure payment gateway provider, Fat Zebra. To successfully complete the 3DS2 cardholder authentication process, the cardholder's details must exactly match the billing information held by the card issuer, including the cardholder's full name, residential address, street number, street name, street type, suburb, state and postcode.
- By completing the online check-in process, signing the Guest Registration Form, providing credit card details, making payment or occupying the property, the Guest expressly authorises First National Real Estate Bribie Island to charge the nominated credit card for any outstanding accommodation charges, merchant fees, additional cleaning charges, damage, breakages, repairs, replacement costs, excess rubbish removal, breaches of these Terms and Conditions and any other amounts properly payable under the booking.
- The Guest acknowledges and agrees that they remain liable for all charges arising from their stay and authorises such charges to be processed against the nominated credit card without further consent where permitted under these Terms and Conditions.
- Credit card information is transmitted through Fat Zebra's secure payment gateway and is not stored on the systems of First National Real Estate Bribie Island.
Cancellations and Refunds
- All cancellation requests must be submitted in writing to First National Real Estate Bribie Island. A cancellation is not effective until written confirmation has been received by our office.
- All bookings are subject to a non-refundable booking fee of $100.
- Where payment has been made by credit card or debit card, any merchant processing fees incurred at the time of payment are non-refundable.
Cancellations More Than 30 Days Prior to Arrival
- Where written notice of cancellation is received more than thirty (30) days prior to the scheduled arrival date, all monies paid will be refunded less the non-refundable $100 booking fee and any applicable non-refundable merchant processing fees.
Cancellations Within 30 Days of Arrival
- Where written notice of cancellation is received within thirty (30) days of the scheduled arrival date, all monies paid will be forfeited and no refund will be payable.
- First National Real Estate Bribie Island reserves the right, at its sole discretion, to consider exceptional circumstances; however, no obligation exists to provide a refund, credit or transfer of dates.
- All apprved refunds will be processed to the original payment method used at the time of booking wherever possible. Where the original payment method is unavailable, invalid, expired or unable to accept a refund, the refund may be paid into a bank account nominated by the Guest and approved by First National Real Estate Bribie Island. The Guest may be required to provide proof of account ownership before any refund is processed.
Early Departure or Reduced Stay
- No refund, credit or reduction in tariff will be provided where a Guest chooses to depart earlier than the booked departure date, arrives later than the booked arrival date, or otherwise fails to utilise any portion of the booked accommodation period.
- Travel Insurance - Guests are strongly encouraged to obtain comprehensive travel insurance at the time of booking to protect against unforeseen circumstances that may result in cancellation, interruption or alteration of travel plans.
Changes to Booking Dates
- Requests to change booking dates must be submitted in writing.
- Changes to booking dates may only be considered where the request is received more than thirty (30) days prior to the scheduled arrival date and are subject to availability and approval by First National Real Estate Bribie Island.
- Approval of a date change is at the sole discretion of First National Real Estate Bribie Island and is not guaranteed.
- Where alternative dates have a higher tariff, the Guest will be required to pay the difference in price. No refund or credit will be provided where the revised booking has a lower tariff unless otherwise agreed in writing.
- Requests to change booking dates within thirty (30) days of arrival will generally be treated as a cancellation and the cancellation policy will apply.
Authorised Charges and Credit Card Authority
- By providing credit card details, completing online check-in, signing a guest registration form, making payment, paying a security bond, or occupying the property, the Guest expressly authorises First National Real Estate Bribie Island to securely store and process their credit card details via its nominated payment gateway provider.
- The Guest further authorises First National Real Estate Bribie Island to charge the nominated credit card for all amounts properly payable under these Terms and Conditions, including but not limited to accommodation charges, security bond deductions, merchant fees, damage costs, repairs, replacement costs, excess cleaning, rubbish removal, call-out fees, penalties, breach-related costs, and any other amounts arising from the Guest’s occupancy of the property.
- Where a security bond applies, the Guest acknowledges that it may be applied towards any outstanding amounts owed under these Terms and Conditions. Any remaining balance will be refunded in accordance with the applicable refund process.
- The Guest acknowledges that all such charges are valid and payable under these Terms and Conditions unless proven to be a genuine billing error.
- The Guest agrees that charges may be processed without further notice where reasonably required under these Terms and Conditions, including charges arising after departure where costs are identified following inspection of the property.
- This clause is included to reinforce and operate in conjunction with other provisions within these Terms and Conditions relating to security bonds, damages, cleaning charges, fees and recovery of costs.
- The Guest further agrees that any costs incurred by First National Real Estate Bribie Island in recovering unpaid, reversed, or disputed charges, including administration costs, debt collection fees, legal fees, and recovery expenses, will be payable by the Guest.
Chargeback Agreement
- The Guest acknowledges and agrees that all charges properly incurred under these Terms and Conditions are valid and enforceable.
- The Guest agrees not to initiate, request, or support any chargeback, reversal, or payment dispute with their financial institution in respect of any charge that has been properly incurred in accordance with these Terms and Conditions.
- In the event a chargeback or payment dispute is initiated for a valid charge, the Guest remains liable for all amounts owed, including the disputed amount and any associated fees, bank charges, recovery costs, and administrative expenses incurred by First National Real Estate Bribie Island in responding to or recovering the amount.
Illness, Pandemics, Government Restrictions and Other Events
- Bookings are made at the Guest's own risk with respect to personal circumstances, illness, injury, pandemics, epidemics, border closures, government directives, travel restrictions, transport disruptions, weather events, employment commitments or any other circumstance that may affect the Guest's ability to travel or occupy the property.
- Unless otherwise required by law, cancellations arising from any of the above circumstances will be treated in accordance with the standard cancellation policy applicable to the booking.
- Guests are strongly encouraged to obtain appropriate travel insurance to cover these risks.
Weather Conditions and Environmental Factors
- No refund, credit, compensation, reduction in tariff, transfer of dates or cancellation without penalty will be provided due to adverse or unfavourable weather conditions or environmental factors.
- This includes, but is not limited to, rain, wind, storms, cyclones, flooding, high tides, rough surf, beach erosion, algae events, marine stingers, bushfire smoke, poor water quality, power outages caused by weather events, road closures, restricted access to local attractions, or any other environmental condition beyond the control of First National Real Estate Bribie Island.
- Guests acknowledge that weather and environmental conditions can change at any time and form part of the risks associated with travelling and staying in a coastal destination. Such circumstances do not constitute grounds for cancellation, refund, compensation or alteration of the booking.
- Guests are strongly encouraged to obtain comprehensive travel insurance to protect against unforeseen circumstances that may affect their travel plans.
Schoolies, Parties, Events and Large Group Bookings
- All properties are subject to a strict No Party and No Event Policy.
- Schoolies groups, bucks parties, hens parties, weddings, engagement parties, receptions, functions, gatherings, celebrations and similar events are strictly prohibited unless expressly approved in writing by First National Real Estate Bribie Island prior to the booking being confirmed.
- First National Real Estate Bribie Island reserves the right to refuse, cancel or terminate any booking that, in its reasonable opinion, may involve a party, event, gathering, Schoolies group or any activity likely to cause disturbance to neighbours, damage to the property or breach of these Terms and Conditions.
- Properties are generally not suitable for persons under 25 years of age without prior written approval. Approval may be granted at the sole discretion of First National Real Estate Bribie Island and may be withdrawn at any time if inaccurate or misleading information has been provided.
- Under no circumstances will Schoolies bookings be accepted.
- Any breach of this clause may result in the immediate termination of the booking, eviction from the property, forfeiture of all monies paid and additional charges for damage, cleaning, security attendance or other associated costs. No refund, compensation or alternative accommodation will be provided.
Maximum Occupancy
- At the time of booking, the Guest must nominate the total number of occupants who will be staying at the property.
- The number of occupants must not exceed the maximum occupancy permitted for the property or the number stated on the booking confirmation.
- Only persons included in the booking may occupy the property unless prior written approval has been obtained from First National Real Estate Bribie Island.
- The Guest must not permit additional persons, visitors, overnight guests, caravans, motorhomes, tents or temporary accommodation structures on the property without prior written approval.
- If the maximum approved occupancy is exceeded, First National Real Estate Bribie Island may immediately terminate the booking and require all occupants to vacate the property without refund.
- Any additional cleaning, damage, wear and tear, call-out fees, security costs or other expenses arising from unauthorised occupants or visitors will be charged to the Guest.
Arrival and Check-In
- Check-in commences from 2:00pm on the scheduled arrival date.
- Early check-in may be available by prior arrangement but is not guaranteed and remains subject to availability, cleaning schedules and operational requirements.
- Guests must not enter or access the property prior to the approved check-in time unless authorised by First National Real Estate Bribie Island.
- Office hours are: Monday to Friday: 8:30am to 5:00pm - Saturday: 9:00am to 4:00pm - Sunday: By appointment only
- Our office is closed on the following public holidays: Easter Sunday, Anzac Day, Christmas Day, Boxing Day, New Year's Day
- Good Friday arrivals are permitted; however, the office is closed and alternative key collection arrangements will apply.
- Where arrival occurs outside office hours, keys may be made available via our secure key safe system. Key safe access instructions will be provided by email and SMS prior to arrival.
- A refundable security bond of $500 may be required for all after-hours arrivals and must be paid prior to key release.
- Under no circumstances will keys, access codes or check-in instructions be provided until all accommodation charges, security bonds (where applicable), completed registration forms and any other required documentation have been received and approved.
- Guests are encouraged to notify First National Real Estate Bribie Island as soon as reasonably practicable if they identify any damage, maintenance issue, cleanliness concern, missing item or other discrepancy upon arrival or during their stay. Prompt notification allows us the opportunity to investigate and, where appropriate, rectify the issue to minimise any impact on your stay.
- Failure to report an issue during the occupancy period may limit our ability to investigate the matter and may be taken into consideration when assessing any subsequent claim for compensation, refund or dispute relating to the condition of the property.
- While every reasonable effort is made to ensure the property is presented in a clean and well-maintained condition, First National Real Estate Bribie Island will have a reasonable period of time to investigate and rectify any reported issue and no refund or compensation will be payable where the issue is resolved within a reasonable timeframe.
Cleaning Standards and Guest Concerns
- All properties are professionally cleaned and sanitised prior to guest arrival. Our cleaning contractors follow established cleaning and disinfecting procedures to prepare the property for each stay.
- Should a guest have concerns regarding the cleanliness of the property upon arrival, they must notify First National Real Estate Bribie Island as soon as possible and provide photographs of the issue where applicable. First National Real Estate Bribie Island reserves the right to arrange for the cleaning contractor to return to the property and rectify any verified cleaning concerns.
- The return of the cleaning contractor to address the issue will be considered the primary and reasonable remedy. Refunds, discounts, compensation, or credits will not be provided for cleanliness concerns unless First National Real Estate Bribie Island has been given a reasonable opportunity to inspect and/or rectify the issue and has been unable to do so.
- Guests who choose not to allow reasonable access for rectification, or who continue their stay without promptly reporting concerns, will not be entitled to any refund, compensation, or reduction in accommodation charges relating to the cleanliness of the property.
Departure and Vacating the Property
- Guests must vacate the property no later than 10:00am on the scheduled departure date unless prior written approval for a late check-out has been obtained from First National Real Estate Bribie Island.
- All keys, remotes, access devices and other items supplied with the property must be returned to the First National Real Estate Bribie Island office at 71 Welsby Parade, Bongaree no later than 10:30am on the departure date unless alternative arrangements have been approved.
- A fee of $50.00 per hour, or part thereof, may be charged for the late return of keys, remotes or access devices. Additional costs incurred as a result of delayed access for cleaners, maintenance contractors, incoming guests or property owners may also be charged to the Guest.
- Guests acknowledge that their right to occupy the property ends at the agreed departure time and date. Unauthorised occupation of the property beyond the approved departure time may result in additional accommodation charges, call-out fees, compensation payable to incoming guests and any other associated costs.
- No refund, credit or reduction in tariff will be provided where a Guest elects to depart prior to the scheduled departure date.
- Late check-out requests are subject to availability, operational requirements and prior approval by First National Real Estate Bribie Island. Approval is not guaranteed and may incur an additional fee.
Property Condition Upon Departure
The property must be left in a clean, tidy and reasonably well-maintained condition, fair wear and tear excepted.
Guests are required to:
- Remove all personal belongings from the property;
- Wash and put away dishes, cookware and utensils used during the stay;
- Clean the BBQ if used during the stay;
- Remove excess rubbish and place rubbish in the appropriate bins provided;
- Leave the property secured upon departure; and
- Return all keys, remotes and access devices as instructed.
The property will be professionally cleaned following departure; however, this does not relieve the Guest of their obligation to leave the property in a reasonable condition.
Any additional cleaning costs, damage, breakages, repairs, replacement costs, excess rubbish removal charges or other expenses incurred as a result of the Guest's occupancy may be charged to the nominated credit card.
This includes, but is not limited to:
- Excessive cleaning requirements;
- Excess rubbish removal;
- Stains or soiling beyond normal use;
- Damage to the property or its contents;
- Missing items;
- Unauthorised pets;
- Excessive pet hair, pet odours or pet-related cleaning in pet-friendly properties; and
- Additional cleaning or sanitisation required as a result of the Guest's actions.
If any damage to the property or its contents is reported during the stay or identified following departure, the Guest accepts full responsibility for the total cost of all repairs, replacements, rectification works and associated expenses.
By completing the Online Check-In Form, signing the Guest Registration Form, providing credit card details or occupying the property, the Guest expressly authorises First National Real Estate Bribie Island to charge the nominated credit card for any amounts properly payable under these Terms and Conditions.
The Guest acknowledges that valid charges incurred under these Terms and Conditions remain payable after departure. Any costs incurred by First National Real Estate Bribie Island in recovering unpaid, reversed or disputed charges, including administration, debt recovery and legal costs, may be recovered from the Guest.
Services
- Properties are offered as self-contained holiday accommodation and are not serviced apartments.
- A limited supply of starter consumables may be provided for Guest convenience, including items such as toilet paper, hand soap, dishwashing liquid, cleaning products and similar household supplies. These items are provided on a complimentary basis only and will not be replenished during the stay.
- Guests are responsible for supplying any additional consumables, household items or personal supplies required during their occupancy.
- The property will be professionally cleaned prior to arrival and following departure.
- Additional cleaning services may be available by prior arrangement through First National Real Estate Bribie Island and will be charged at the Guest's expense. Requests for additional cleaning should be made prior to arrival wherever possible and remain subject to availability.
Linen
- Linen provisions vary between properties. Guests should refer to the individual property listing, booking confirmation and property information to determine whether linen is supplied.
- Where linen is not supplied with the property, Guests are responsible for arranging and supplying their own linen.
- As a convenience only, Guests may arrange linen hire directly through Sweet Sheets Linen Hire (Linda - 0404 300 302) at their own cost. First National Real Estate Bribie Island acts solely as a referral source and accepts no responsibility or liability for the products or services provided by third-party linen hire suppliers.
- All beds used during the stay must be fitted with appropriate linen, including sheets and pillowcases.
- Where bedding, mattresses, mattress protectors, quilts, doonas, pillows or other linen items require additional laundering, stain treatment, sanitisation, repair or replacement because linen was not used, the Guest will be responsible for the associated costs.
- Unless otherwise specified, linen is supplied for the commencement of the stay only and will not be changed or serviced during occupancy.
- Guests may use the washing machine and laundry facilities provided at the property to launder linen during their stay.
- Additional linen and linen change services may be available during the stay at the Guest's expense. Any requests for additional linen or linen changes must be arranged through First National Real Estate Bribie Island and are subject to availability and applicable service fees.
Pets
A non-refundable pet fee of $40, $50, $100 or $150 per dog applies, depending on the property booked. The applicable pet fee will be confirmed at the time of booking.
Pets are permitted only at properties specifically advertised as pet-friendly and only with prior approval from First National Real Estate Bribie Island.
Unless expressly stated otherwise for a particular property, pets must remain outside the property at all times and are not permitted indoors. Pets are not permitted on furniture, bedding, or soft furnishings unless specifically authorised for the property.
Properties not advertised as pet-friendly do not permit pets under any circumstances, including visiting pets. If a pet is found on-site at a non-pet-friendly property, First National Real Estate Bribie Island may immediately terminate the booking, require the Guest to vacate the property without refund, and charge any additional cleaning, damage, sanitisation, or other associated costs incurred.
- For pet-friendly properties, the Guest is responsible for ensuring that:
- All pet waste is collected and disposed of appropriately;
- The property and grounds are left free from fleas, pet hair, odours and other pet-related debris;
- Pets do not cause damage to the property, furnishings, lawns, gardens, fences or neighbouring properties; and
- Pets do not disturb neighbours through barking, noise or aggressive behaviour.
If there is evidence that a pet has been inside the property where not permitted, on furniture, bedding or soft furnishings, or has caused any damage to the property, furnishings, or grounds, First National Real Estate Bribie Island may charge the Guest for any additional cleaning, deodorising, sanitisation, flea treatment, repair, replacement, or other associated costs. Such costs may be deducted from the Guest's security deposit or charged to the payment method provided.
Failure to comply with this clause may result in immediate termination of the booking and eviction from the property without refund.
Service and Assistance Animals
Guests travelling with a service dog or assistance animal must notify First National Real Estate Bribie Island at the time of booking or as soon as reasonably practicable prior to arrival.
Prior to check-in, guests may be required to provide reasonable evidence that the animal is a legitimate assistance animal, including:
- Documentation from a registered training organisation, medical practitioner, or relevant authority confirming the animal is trained to assist with a disability;
- Evidence that the animal meets public access standards and is appropriately vaccinated and registered in accordance with local regulations.
The assistance animal must:
- Remain under the guest’s control at all times;
- Be appropriately trained and behaved;
- Not create excessive noise, disturbance, aggression, or nuisance to neighbours or other guests;
- Not be left unattended at the property unless safely contained.
For hygiene and property protection, assistance animals are not permitted on furniture, beds, or in swimming pools.
Guests are fully responsible for:
- Any damage caused by the animal;
- Additional cleaning required due to accidents, odours, or excessive shedding;
- Any costs arising from breaches of these conditions.
First National Real Estate Bribie Island reserves the right to refuse accommodation where:
- Reasonable evidence of assistance animal status is not provided when requested;
- The animal is not under effective control;
- The animal poses a direct threat to the health, safety, or quiet enjoyment of others;
- The presence of the animal would cause an unjustifiable hardship, including where prohibited by applicable body corporate bylaws or legal restrictions.
Smoking/Vaping
All property interiors are strictly non-smoking.
Some properties may also have a complete non-smoking policy applying to both indoor and outdoor areas of the property. Guests must comply with the specific smoking rules applicable to the property booked.
Guests must not smoke or vape inside the property, on balconies or patios where prohibited, or in any area where smoking restrictions apply.
If smoking or vaping occurs in breach of this clause, the Guest may be charged for:
- Professional cleaning and deodorising;
- Cleaning or replacement of carpets, furnishings, curtains, bedding and window coverings;
- Additional housekeeping costs;
- Fire alarm call-out costs;
- Any costs associated with smoke or vaping-related damage, contamination, odours, staining, repairs, replacements, loss of income, or other losses not covered by the property's insurance policies; and
- Any other costs reasonably incurred as a result of the breach.
- Insurance policies may not cover all damage or losses arising from smoking or vaping. The Guest agrees to indemnify and reimburse First National Real Estate Bribie Island and/or the property owner for all costs, losses, damages, cleaning expenses, repairs, replacement costs, loss of income, and other expenses incurred as a result of any smoking or vaping-related breach of this clause, including any amounts not recoverable under applicable insurance policies.
BBQ Use
- Where a barbeque is provided, it must be left in a clean and tidy condition, ready for use by the next Guest.
- Guests are responsible for cleaning the barbeque after use, including the grill plates, trays and surrounding area.
- A cleaning fee of $50 will apply if the barbeque is left in an unclean condition requiring additional cleaning by our staff or contractors.
- If the barbeque is found to be unclean upon arrival, the Guest should contact our office as soon as reasonably possible so that arrangements can be made for cleaning.
Parking
- Guests and their visitors must park vehicles, boats, trailers and other equipment only in the designated parking areas allocated to the property.
- Parking on lawns, gardens, neighbouring properties, common property, driveways not designated for parking, or in any area where parking is prohibited is not permitted.
- Where a property is part of a strata or community title complex, Guests must comply with all parking rules, by-laws and permit requirements applicable to the complex.
- Some strata-titled properties may require a parking permit to be displayed on the dashboard while parked within the complex. Guests are responsible for ensuring any required permit is displayed at all times.
- First National Real Estate Bribie Island accepts no liability for parking fines, towing costs, damage to vehicles, or losses arising from a Guest's failure to comply with parking requirements.
Waste Disposal and Bins
- Guests are responsible for the proper disposal of household rubbish during their stay.
- Garbage and recycling bins should be placed out for collection and returned to the property as required. Collection schedules are generally displayed within the property for Guest reference.
- Guests must ensure that rubbish is securely bagged and placed in the appropriate bins provided. Excess rubbish must not be left at the property, around bins, or on neighbouring properties.
- Where excessive rubbish is left at the property, additional waste removal is required, or bins are not presented for collection resulting in additional servicing being required, First National Real Estate Bribie Island reserves the right to charge the Guest for any associated costs.
Smoke Alarms
- All smoke alarms installed at the property comply with current Queensland legislation and safety requirements.
- Guests must not tamper with, disable, remove, cover, disconnect or otherwise interfere with any smoke alarm, smoke detector or associated safety equipment.
- Many properties are fitted with interconnected smoke alarms, meaning that when one alarm is activated, all alarms within the property may sound.
- In the event a smoke alarm activates during your stay and there is no apparent emergency, Guests should follow the instructions provided within the property or contact First National Real Estate Bribie Island for assistance.
- If a smoke alarm continues to activate without the presence of smoke or fire, Guests should contact our office or after-hours emergency service as soon as reasonably practicable so appropriate arrangements can be made.
- Any costs associated with the tampering, disabling, removal or damage of smoke alarms or safety equipment by a Guest or visitor will be the responsibility of the Guest.
- Guests acknowledge that smoke alarms are a legal safety requirement and must remain operational at all times.
Window Furnishings and Blind Cords
- For the safety of all occupants, Guests must exercise appropriate care when using blinds, curtains, cords, chains and other window furnishing components.
- Guests are responsible for supervising children around blind cords and curtain chains and ensuring that they are used safely and in accordance with any safety devices fitted to the property.
- Any damage caused to blinds, curtains, cords, chains, safety devices or associated fittings during the booking period may be charged to the Guest.
Pool Tables and Recreational Equipment
- Where a property provides a pool table, games equipment or other recreational facilities, Guests use such facilities entirely at their own risk.
- Guests are responsible for ensuring that all equipment is used appropriately and for its intended purpose.
- Any damage to a pool table, cues, balls, accessories, lighting, surrounding furniture, walls, ceilings, windows, flooring or any other part of the property arising from the use or misuse of recreational equipment will be the responsibility of the Guest.
- The cost of repairs, replacement, rectification works and any associated expenses may be charged to the Guest in accordance with these Terms and Conditions.
Swimming Pools and Spa Areas
- Where a property includes a swimming pool, spa or pool area, Guests and visitors use these facilities entirely at their own risk.
- Guests are responsible for ensuring that all occupants and visitors comply with pool safety requirements and exercise appropriate care when using the pool or surrounding areas.
- Children must be actively supervised by a responsible adult at all times when in or around the pool area. Children must not use the swimming pool or spa without adult supervision.
- For safety reasons, glassware, glass bottles and other breakable glass products must not be used in or around pool and spa areas.
- Running, diving, jumping from structures, rough play and any behaviour that may cause injury or property damage is prohibited.
- Pool pumps, filters, chlorinators, timers, heating systems, cleaning equipment and other pool-related equipment must not be tampered with, adjusted, disconnected or interfered with in any way.
- Any costs incurred as a result of damage to, misuse of, or interference with pool equipment may be charged to the Guest, including call-out fees, repairs, cleaning, replacement costs and loss of use.
- All inflatable toys, floating devices and other personal pool equipment brought onto the property must be removed from the pool and surrounding areas prior to departure.
- Temporary, portable, inflatable or above-ground pools and spas must not be erected, installed or used at the property under any circumstances.
- Guests acknowledge that local government regulations may apply to temporary pools and spas capable of holding more than 300mm of water and that significant penalties may be imposed by the relevant authority for non-compliance. Any fines, penalties, costs or liabilities arising from a Guest's breach of this clause will be the sole responsibility of the Guest.
- First National Real Estate Bribie Island accepts no responsibility for accidents, injuries, loss, damage or death arising from the use of any pool, spa or recreational water facility at the property, except to the extent liability cannot be excluded by law.
Lost Property
- Guests are responsible for ensuring that all personal belongings are removed from the property upon departure.
- If a Guest believes an item has been left behind, they should contact First National Real Estate Bribie Island as soon as reasonably practicable following departure.
- Whilst reasonable efforts will be made to locate and identify lost property, First National Real Estate Bribie Island accepts no responsibility for items left behind, including items that are lost, damaged, stolen, misplaced or disposed of.
- Items recovered from a property will be held for a maximum period of fourteen (14) days from the date they are found. After this period, unclaimed items may be donated to a local charity, disposed of, or otherwise dealt with at the discretion of First National Real Estate Bribie Island.
- Lost property will only be returned at the Guest's expense. Guests must provide a prepaid postage satchel, courier label or other approved return method before any item will be dispatched.
- A $30 administration and handling fee applies to all lost property requests to cover staff time, storage, packaging and processing costs. This fee must be paid in full prior to any item being released or returned.
- First National Real Estate Bribie Island reserves the right to refuse handling or return of items where the administration fee and postage arrangements have not been provided.
Care of Premises
Guests must take proper care of the property, its contents and surrounding areas at all times during the booking period.
Where the property is located within a strata, community title or managed complex, Guests must also comply with all applicable body corporate by-laws, rules, regulations and lawful directions of the scheme, in addition to these Terms and Conditions.
Guests are responsible for ensuring that all occupants and visitors behave in a reasonable and respectful manner and do not cause damage, disturbance or nuisance to the property, neighbouring properties, common property or the wider community.
Without limitation, Guests must ensure that:
- Noise is kept at a level that does not unreasonably disturb neighbours at any time;
- The property, common property (where applicable) and surrounding areas are not damaged, misused or subjected to negligent or reckless behaviour;
- All occupants and visitors comply with all applicable by-laws, rules and reasonable instructions issued by First National Real Estate Bribie Island, the property owner, or the body corporate (where applicable);
- Vehicles, boats, trailers and other transport are parked only in designated and lawful areas; and
- No animals are brought onto the property unless the property is expressly advertised as pet-friendly or the animal is an approved assistance animal recognised under Queensland legislation.
Guests are responsible for the actions and behaviour of all occupants and visitors at the property during the booking period, including any breaches of body corporate by-laws where applicable.
If any of the above requirements are breached, First National Real Estate Bribie Island reserves the right to issue warnings, attend the property if required, or terminate the booking immediately without refund. The Guest may also be liable for any fines, penalties, damage, cleaning costs or other expenses arising from the breach.
Repairs and Maintenance
- The Guest agrees to allow First National Real Estate Bribie Island, the property owner, and/or authorised contractors reasonable access to the property at any time during the booking period to inspect, investigate or carry out repairs, maintenance or urgent works.
- All reasonable efforts will be made to attend to repairs and maintenance issues as soon as practicable. However, delays may occur due to contractor availability, public holidays, after-hours call-outs or other circumstances beyond our control.
- Guests must promptly notify First National Real Estate Bribie Island of any maintenance issues, faults, damage, defects or repairs required at the property. Guests must not arrange, authorise or engage any third-party contractor, tradesperson, repairer, cleaner or service provider without the prior written approval of First National Real Estate Bribie Island. No reimbursement, compensation, credit or refund will be provided for any repairs, maintenance, services, replacement items or other expenses arranged by the Guest without prior approval.
- No refund, compensation, discount or relocation will be provided due to delays in attending repairs or maintenance matters, provided that reasonable efforts are made to rectify the issue.
- Where a property becomes uninhabitable due to a major fault or unforeseen circumstance, First National Real Estate Bribie Island will make reasonable efforts to arrange alternative accommodation where available; however, this cannot be guaranteed.
- If First National Real Estate Bribie Island, the property owner, or any authorised contractor is required to attend the property due to Guest conduct, including but not limited to neighbour complaints, breach of by-laws, excess rubbish, additional cleaning, damage, misuse or breach of these Terms and Conditions, all associated costs will be charged to the Guest.
- If any damage to the property or its contents is reported during the stay or identified following departure, the Guest accepts full responsibility for the total cost of all repairs, replacements, rectification works and associated expenses.
- By completing the Online Check-In Form, signing the Guest Registration Form, providing credit card details or occupying the property, the Guest expressly authorises First National Real Estate Bribie Island to securely store and process credit card details via Fat Zebra for the purpose of charging all amounts properly payable under these Terms and Conditions, including accommodation charges, merchant fees, cleaning costs, damage, repairs, replacement costs and any other applicable charges.
- The Guest authorises First National Real Estate Bribie Island to charge the nominated credit card for such amounts without further notice where reasonably required.
- The Guest acknowledges that all valid charges are payable under these Terms and Conditions and must not be disputed or reversed with any financial institution except where a genuine billing error has occurred. Any costs incurred in recovering disputed or reversed charges, including administration, debt recovery and legal costs, will be recoverable from the Guest.
Noise Complaints and Disturbances
- Guests must at all times respect neighbouring properties and the local community.
- Excessive noise, disruptive behaviour, parties, or any form of anti-social conduct is strictly prohibited and may result in immediate termination of the booking without refund, as well as additional charges for any associated costs incurred.
- Guests and visitors must ensure that noise is kept to a reasonable level at all times, and in particular between 10:00pm and 8:00am. Guests must comply with any reasonable direction from police, council officers, body corporate representatives or other authorised authorities, including any noise abatement notices or orders. Guests acknowledge that neighbouring residents may contact local police regarding noise, disturbances, parties, anti-social behaviour, or other breaches of this clause, and any resulting attendance, action or costs arising from the Guest's conduct may be charged to the Guest.
- Guests are responsible for ensuring that the conduct of all occupants and visitors does not negatively impact the residential amenity of neighbouring properties or the surrounding community.
- If First National Real Estate Bribie Island, the property owner, authorised contractors, security personnel, police, council officers, body corporate representatives or other authorities are required to attend the property as a result of Guest conduct, all associated costs may be charged to the Guest.
- First National Real Estate Bribie Island is not responsible for, and has no control over, construction, renovation, maintenance or development works occurring on neighbouring properties or within the surrounding area. No refund, compensation or relocation will be provided in such circumstances, whether or not prior notice has been received. While reasonable efforts may be made to notify Guests of known works, such notification cannot be guaranteed.
Emergencies
In the event of a life-threatening emergency, Guests must contact emergency services immediately by calling 000.
For urgent property-related emergencies only, the following contacts may be used:

These contacts are provided for genuine urgent issues only and not for general maintenance requests.
Call-Out Fees
Where First National Real Estate Bribie Island is required to attend the property due to Guest conduct, including but not limited to noise complaints, disturbances, misuse of the property or breaches of these Terms and Conditions, a call-out fee of $100.00 will apply. This fee is payable immediately upon request and may be charged to the nominated credit card.
Lockout Fees
If Guests are locked out of the property, they must contact First National Real Estate Bribie Island.
A call-out fee of $100.00 applies for lockout assistance during office hours. Guests will be required to attend the office at 71 Welsby Parade, Bongaree to collect spare keys, which must be returned by the following business day.
Where attendance by a locksmith is required, all locksmith costs are the sole responsibility of the Guest. On public holidays or outside normal office hours, Guests may be directed to contact Bribie & District Locksmiths on 0420 305 625 or another nominated provider.
First National Real Estate Bribie Island accepts no responsibility for locksmith charges or related costs.
Lost Keys
Guests must notify First National Real Estate Bribie Island immediately if keys are lost during their stay. Where keys are not recovered prior to departure, the Guest will be responsible for all costs associated with replacement keys, rekeying, lock replacement or security upgrades required as a result of the loss.
Any such costs may be charged to the nominated credit card in accordance with these Terms and Conditions.
Interpretation and Priority of Terms
In the event of any inconsistency or conflict between these Terms and Conditions and any marketing material, website content, booking platform listing (including third-party platforms), advertising, or verbal representations, these Terms and Conditions shall prevail to the fullest extent permitted by law.
No Waiver
No failure or delay by First National Real Estate Bribie Island in exercising any right, power, or remedy under these Terms and Conditions shall operate as a waiver of that right, power, or remedy.
Any single or partial exercise of any right, power, or remedy shall not prevent any further or other exercise of that or any other right, power, or remedy.
General Terms and Conditions
- All bookings are accepted on behalf of the property owner. First National Real Estate Bribie Island acts as the managing agent only and cannot accept responsibility for any actions, decisions or circumstances of the property owner that are outside the reasonable control of the agency.
- The Agent reserves the right to cancel or amend any booking where required by the property owner. In such circumstances, the Guest will be notified as soon as reasonably practicable. Where possible, reasonable efforts will be made to offer alternative accommodation or amended dates. If this is not possible, all monies paid by the Guest will be refunded in full. No further compensation, claim or liability shall arise.
- The Agent and/or property owner accept no responsibility for events outside their reasonable control, including but not limited to power outages (planned or unplanned), internet interruptions, water supply interruptions, weather events, infrastructure failures or service disruptions. Guests are directed to contact relevant service providers such as Energex (13 62 62) where applicable. No refund, compensation or reduction in tariff will be provided in such circumstances.
- The property is provided for short-term holiday accommodation only for the period stated on the booking confirmation. No commercial business, trade, profession or enterprise may be conducted from the property without prior written approval.
- All property descriptions, photographs and representations are provided in good faith and to the best of the Agent’s knowledge at the time of publication. Guests acknowledge that minor variations may occur and it is the Guest’s responsibility to ensure the property is suitable for their requirements. No refund or compensation will be provided on the basis that the property is not subjectively suitable.
- Each property may be subject to additional rules, conditions or instructions which form part of these Terms and Conditions and/or are provided in the property compendium or booking information. Guests are responsible for ensuring compliance with all such requirements.
- Where a property is listed for sale, the Guest agrees to permit reasonable access for inspections by prospective purchasers or real estate agents during reasonable hours, with prior notice where practicable.
- Where the property is located within a strata or community title scheme, all applicable by-laws, rules and lawful directions must be complied with at all times. First National Real Estate Bribie Island has no control over the by-laws or rules of any strata or community title scheme. Some properties may require Guests to sign additional body corporate documentation as a condition of occupancy.
- Guests are responsible for the security of the property during their stay and upon departure, including locking doors and securing windows. Any loss, theft or damage resulting from failure to secure the property will be the responsibility of the Guest.
- The Agent and property owner accept no responsibility for loss, theft, damage or injury to Guests, visitors or their personal property, except where liability cannot be excluded by law. Guests are strongly advised to obtain appropriate travel and contents insurance.
- Bookings are accepted based on the property ownership at the time of booking. If a property is sold, continued availability cannot be guaranteed.
- The Agent reserves the right to refuse any booking at its discretion, including where instructed by the property owner or where the booking is considered unsuitable for the property.
- Tariffs, fees and charges are subject to change until a booking is confirmed. Quoted prices are valid for thirty (30) days unless otherwise stated.
- Guests acknowledge that failure to comply with these Terms and Conditions may result in, without limitation, cancellation of the booking, eviction from the property, forfeiture of monies paid, and/or charges being applied to the nominated credit card for costs incurred.
- These Terms and Conditions may be amended or updated from time to time. The most current version will be available on the First National Real Estate Bribie Island website or upon request.
- By proceeding with a booking, making payment, completing online check-in or occupying the property, the Guest acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.
